Can I be penalized for only utilizing one insurance, when I actually have two?

I have carried family coverage with my employer since 8/04, when I became employed at my current job. Just recently I have found out that my husband has family coverage through his employer since 9/04 as well. Since I was unaware of this other insurance, I have only used mine for all our family's medical needs. My husband just had a kidney transplant on 1/24/06, and during his hospital stay, this is when I was informed of his medical coverage. I immediately called the financial office at the Medical Center and informed them, and since, have presented both medical cards for new prescriptions and follow up visits to the transplant center. Just today, I called his group insurance company to have personal information updated (as on their website, they had my DOB wrong and our daughter's name misspelled) and then to request id cards (since we did not have any from them). That is when the representative informed me that we would be penalized for not disclosing the primary insurance (my group policy) and that first, we will be fined $500, then told me to contact my insurance company and tell them he has another policy, at that time, they will re-process all claims and we (my husband and myself) will be billed the difference. (?????) I was informed by the HR person at my husband's employment, that my insurance is primary due to my birthdate. Please let me know anything you can about this, they have me VERY nervous at this point.
